Subscriptions & Sign-Ups
We have the right to refuse the selling of our products or services, or use of anything on our site, especially in cases where we determine that an individual is being abusive, obscene or inappropriate to other users. All refund requests for purchased products must be requested within 30 days of the purchase. Our content-based subscription product is good for 365 days from the date of purchase, so if one purchases in May 1 of 2012, that user will have access to the subscribed-to content through May 1, 2013. By signing up for a DraftCalc subscription product, you confirm that DraftCalc may send you e-newsletters to the email address used and maintained within your DraftCalc user account. Of course, if for any reason you do not wish to get emails from DraftCalc despite this acknowledgement, just email us and let us know so that we can unsubscribe you from our mailing list (you may also unsubscribe via any one of our emails sent to your account-provided email address). DraftCalc reserves the right to add or discontinue any of its services without warning or notice, including products, features or services inside any of our content subscriptions or products. However, in most cases, we only add to our product lines, thus providing our subscribers and purchasers more products, features and information than originally described within any of our product, feature or service descriptions. DraftCalc, any of its writers, owners, partners or affiliates, make no guarantees about the advice and guidance provided by our products, features or services, nor do we make any guarantees about the accuracy of any of the information, services, features provided. We, and our products, are opinion-based, and we do not promote gambling in any way; our content, features, services and advice is merely opinion for leagues based on fun. Contests & Giveaways
We reserve the right to terminate subscriptions that have been provided to users during promotions, for example, terminating a subscription due to a user being abusive, threatening, disruptive to the community, or if the user is doing anything else that we, DraftCalc (or staff) feel is unwarranted. In our “Win a FREE Lifetime Subscription” contest, “Lifetime” is considered for as long as DraftCalc remains under current management/ownership (current as the management at the time of the giveaway), and the promotion will only last for as long as the product that was given to the users remains. Meaning, if paid subscriptions are eliminated on the site, there would no longer be a “FREE Lifetime Subscription” product to provide for free. Price increases do not affect the “FREE Lifetime Subscription” product, meaning if that product, which is given to the user for the life of the product (and for as long as the product is under the management/ownership that provided it), will be provided to the user for FREE regardless of year-to-year price increases. As for our “Win a FREE Lifetime DraftCalc Subscription” product that relates to Photo submissions (for example our 2013 promotion), all entries must be submitted by the owner of the photo, or have complete and full rights to use the photo submitted. DraftCalc (DraftCalc, LLC) is not responsible for improper use of submitted photos, and we warn all users to submit only photos that they have ownership rights to, or rights of use, therefore, DraftCalc cannot be held liable for using submitted photos that violate such things; anyone that wishes to remove a photo from our submission promotions should email us immediately. Users do not have to physically be in the submitted photo, but again, the submitter must own the photo, or have rights to use the photo however they want. There will be only one winner of the 2013 “Win a FREE Lifetime DraftCalc Subscription (or other name variation) contest, although, DraftCalc reserves the right to offer secondary prizes to runner-ups.
Language & Inappropriate Behavior
We will not tolerate abusive, or derogatory, remarks, or comments, directed toward our users, or our site. Swearing or using profanity is not permitted on the DraftCalc.com forums, or anywhere on the DraftCalc.com site. Personal attacking other users is also not permitted, which means that we will not tolerate any user using inappropriate language toward another user. DraftCalc.com reserves the right to define what “personal attacking” and “inappropriate language” is. While in most cases we will follow the below “Warning System” guidelines for offenders, however, DraftCalc.com reserves the right to immediately ban a user if we feel that user is not following the forum rules, or is not acting in the best interest of the site, our users, or our forum community.
Warning System
- First Offense: A warning, via private message or discussion response
- Second Offense: An additional warning will be provided to the offending user, accompanied with possible suspension of commenting and forum posting abilities (permanent or temporary, determined at the discretion of DraftCalc.com)
- Third Offense: Complete ban from the use of DraftCalc.com or its forums
Indemnity
By using/viewing DraftCalc.com, or its forum, you agree to defend, indemnify and hold harmless DraftCalc.com with respect to any and all costs, claims, demands, liabilities, investigations, losses, damages, judgments, settlements, costs and expenses, including attorneys’ fees arising out of, or in connection with, this agreement, including, without limitation, your use of our Site and Our Services.
THIS AGREEMENT AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF ARIZONA, WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. The parties irrevocably submit and agree to the exclusive jurisdiction and venue of the Arizona state and Federal Courts in, and for, Maricopa County.
